This lawsuit is an opportunity for Sudanese DV-2023 selectees to challenge the failure of the Kentucky Consular Center (KCC) to reassign Sudanese DV-2023 selectees from US Embassy Khartoum to other embassies that are open.
All DV-2023 selectees face many barriers related to getting interviews and visas, but if KCC never reassigns Sudanese DV-2023 selectees to U.S. embassies that are open, they will be unable to attend consular interviews prior to the end of the fiscal year. We know this because we have seen it happen before with Iraqi and Afghan DV selectees in prior years.
We will be filing this lawsuit in the U.S. District Court for the District of Columbia.

To participate in this lawsuit, DV-2023 selectees must:
(1) have completed and submitted their DS-260 application,
(2) chosen US Embassy Khartoum on the DS-260 application, and
(3) have emailed KCC asking for your interview location to be reassigned to another U.S. embassy. (If you have not done that yet, do it now and you can participate.)
(4) have a case number rank that will be current in the June visa bulletin (made available in May). This means the DV-2023 selectee must have a case number rank below the Africa allocation cut-off number of 63,500.
Cost to Participate:
The attorney fee to participate as plaintiffs in the lawsuit will be $1,000 for each DV-2023 selectee. This fee includes the cost of participation of all derivative beneficiaries regardless of family size.
Note: derivatives will not be named plaintiffs because moving the DV selectee’s interview location will, in most cases, move the interview locations for derivatives.

Answer: We will be challenging the legality arbitrary and capricious decision made by KCC not to allow Sudanese DV-2023 selectees to change their assigned embassy.
6. What solutions does this lawsuit seek?
Answer: We want the State Department, KCC, and embassies to allow our Sudanese DV-2023 clients to change their assigned embassy.
7. What is the deadline to join this lawsuit?
Answer: The deadline for joining the lawsuit is May 16, 2023, 2023 at 11:59 PM Sudan time (GMT+2). That deadline is in concrete and will not be extended under any circumstances. However, please keep in mind that the earlier plaintiffs join the lawsuit, the better we can integrate our plaintiffs’ facts into our arguments, which will result in a stronger and more convincing complaint. If everyone waits to join until May 16, we will have less time, to prepare the best possible complaint. Time is of the essence, and we appreciate all those who choose to participate early.

Answer: This litigation will be filed in the U.S. District Court for the District of Columbia. Note: there is no guarantee as to which judge we will be assigned. The assignment of our judge is unknown and will remain unknown until after the case is filed.
9. What steps will this lawsuit take to arrive at a solution? How soon will we achieve results?
Answer: As with all lawsuits, there are no guarantees. However, the idea is to get judicial oversight of a KCC decision that is causing you injury (decision to not allow Sudanese DVs to change their embassy). If we don’t file a lawsuit, we don’t have judicial oversight of that decision.
10. Will you ask the judge to reserve unused visas before FY 2023 ends?
Answer: Our first focus is getting our plaintiffs’ interview locations changed to U.S. embassies that are open, so we can get their visas issued before the September 30 deadline. If visas are issued to all our plaintiffs before the end of the fiscal year, reserving visas becomes irrelevant.
However, we will also ask for unused visas to be reserved for our plaintiffs, although understand we do not always get all that we ask for.
11. KCC has not confirmed that my DS-260 is processed or that my case is current. Will this litigation help my case?
Answer: These are separate barriers from KCC’s failure to reassign Sudanese cases to other embassies. It is important to remember you must remove all barriers to your visa issuances. The focus of this lawsuit is removing the interview location barrier.
12. Do I have to pay the remaining balance immediately when I enter the U.S.?
While we prefer prompt payments, we understand that circumstances may prevent you from paying immediately upon your entry. If you are unable to pay at entry, we will work out a reasonable schedule with you at that time.
13. What will happen if my visa application is refused and/or I am unable to enter the U.S.? Do I still owe the remaining balance?
Answer: No.
14. What are the attorney fees for family of two or more?
Answer: The fee for all families is the same. We only charge the DV selectee. We are not charging extra fee for derivative spouse or children.
15. Is the litigation guaranteed to win?
Answer: No. No litigation is ever guaranteed. Plus, that is not our goal. Our goal will always be the issuance of visas to our clients and that starts with changing your interview locations.
16. I have a case number that is above 63,500. Can I participate in this lawsuit?
Answer: No.
17. If the judge has not ruled yet and my visa is issued, do I still have to pay the remaining fees when I enter the U.S.?
Answer: Yes, when you will sign a retainer agreement, you sign a legally binding contract. You are promising to pay the remaining balance when you enter the U.S. The attorney fees due under our retainer agreement are not contingent upon the issuance of a judicial order. The fees due are contingent only upon the DV selectee’s entry into the U.S. Any belief that the visa was issued for any other reason does not change your obligation to pay the remaining fees.
Remember: the goal of our litigation is to allow you to change your interview location so you can be interviewed and issued visas. The goal is not the issuance of a judge’s order. To reiterate, if the State Department issues you a visa that you use to enter the US, then you must pay the remainder of the attorney fees.

The second lawsuit, Tesfaye v. Blinken, was a much tougher fight but most plaintiffs in that case were issued DV-2022 visas and are now living in the U.S.

US citizens who have spouses and children awaiting immigrant visas from US Embassy Islamabad (primarily Afghan and Pakistani nationals) are facing unreasonable, and thus we argue unlawful, delays in the adjudication of their loved ones’ visa applications. These are visa applications in the categories known as IR1/IR2 and CR1/CR2.
At US Embassy Islamabad, the immigrant visa backlog for the Immediate Relative categories is not decreasing but steadily increasing. In November 2022, Curtis Morrison, through Morrison Urena, L.C., filed a lawsuit known as Naveed v Blinken to challenge unlawful causes for the unreasonable delays.
Now, Curtis Morrison, through Red Eagle Law, L.C., is offering another group lawsuit to challenge the lawfulness of the cause of those delays. Participants will also receive consular processing representation and guidance through the interview process.
Below find the 3 State Department policies that we will challenge and more information about this litigation opportunity.
On November 16, 2022, Secretary of State Antony Blinken sent a cable known as 21 STATE 115378 with the subject line, “Recalibration of Consular Services Prioritization at Posts Abroad.” This cable, for the first time, vested new authority to consular chiefs to “determine the priority order of consular services processed at post[s].” Prior to 21 STATE 115378, no record exists in the Immigration and Nationality Act or history of the State Department of consular chiefs having the broad authority and discretion to choose which visa categories to prioritize, and which ones to neglect.
What came next should have been expected: the arbitrary discretion has led to disparate outcomes from embassy to embassy, with devastating outcomes for US citizen spouses and children whose interview location is US Embassy Islamabad.
For example, someone at US Embassy Islamabad made the decision to prioritize other visa categories, and particularly nonimmigrant visa categories, above the IR1/IR2 and CR1/CR2 visa categories.
Thus, Secretary Blinken’s November 16, 2022 Recalibration Policy that vested new authority to consular chiefs to determine the priority order of consular services processed at posts, is largely responsible for the unprecedented backlogs faced by IR1/IR2 and CR1/CR2 visa category applicants assigned to US Embassy Islamabad.
Related to the same cable, this lawsuit will challenge the lawfulness of Secretary of State Antony Blinken’s directive, first introduced in 21 STATE 115378 and later enshrined in policy, to prioritize nonimmigrant visas over immigrant visas. Prior to 21 STATE 115378, no record exists in the Immigration and Nationality Act or history of the State Department of a Secretary of State prioritizing nonimmigrant visas over immigrant visas.
Secretary Blinken also made deliberate arbitrary and capricious decisions to understaff US Embassy Islamabad. For example, we know that three vacant positions were designated as “DO NOT FILL” for FY-2021. We also know that the embassy experienced “significant staffing gaps” when the decision was made that for three vacant positions, only second-tour First And Second Tour (FAST) officers could be assigned to that post. Finally, when US Embassy Kabul closed August 2021, creating a surge of demand at US Embassy Islamabad, the State Department reassigned only one consular officer from that post to US Embassy Islamabad.
Contrast these decisions with decisions made regarding staffing at US Embassy Warsaw and US Embassy Frankfurt, who also face relocation crises for the close of US Embassy Kiev and US Embassy Moscow and the surge in applications from Ukrainians and Russians, yet neither embassy now has a sizeable backlog.
Thus, Secretary Blinken’s deliberate arbitrary and capricious choice to understaff US Embassy Islamabad, is largely responsible for the unprecedented backlogs faced by IR1/IR2 and CR1/CR2 visa category applicants at that embassy.
Given the devastating impacts of these decisions by Secretary Blinken, we will be filing the lawsuit on behalf of affected visa applicants who register to participate as plaintiffs. Registration ends on June 15, 2023. The lawsuit will be filed on June 30, 2023.
Note: Diversity Visa Selectees are not eligible to participate in this lawsuit.
The total cost to participate will be $1,500. The terms by which those attorney fees are payable are $500 due upon registration and $1,000 deferred and due upon issuance of visa to spouse/child and their entry into the United States.

Answer: The deadline for joining the lawsuit is June 15, 2023, at 11:59 PM PST (California time). That deadline is concrete and will not be extended under any circumstances. However, please keep in mind that the earlier plaintiffs join the lawsuit, the better we can integrate our plaintiffs’ facts into our arguments, which will result in a stronger and more convincing complaint. If everyone tries to join on the last day, we will have less time to prepare the best possible complaint. We appreciate all those who choose to participate early.
